Fotografare o riprendere con il cellulare qualcuno in un luogo pubblico, senza il suo consenso, può configurare il reato di cui all’art. 660 c.p., anche nel caso in cui il soggetto non si renda conto di essere ripreso, ed è dunque ammissibile il sequestro probatorio del cellulare.
Photographing or filming someone with a mobile phone in a public place, without his consent, can configure the crime ex art. 660 c.p., even if he didn’t realize he was filmed. Therefore the seizure of the mobile phone is admissible.

ITALIAN ANTI-FAKE BILL
The bill proposes a fine of € 5.000 for fake news reporting; “hate campaigns against individuals” or stories “aimed at undermining the democratic process” would merit a fine € 10.000. News items that cause “alarm to the public” or “damage the public interest” would be punishable by up to one year in jail.
Print media would be exempt from the legislation.
Operators of any online news outlets would have to register with authorities before opening a blog or a discussion forum, and they would have to monitor information transmitted, particularly with regard to content to which users express widespread and sudden attention.
