La diffusione di un messaggio diffamatorio attraverso l’uso di una bacheca “facebook” integra l’ipotesi di diffamazione aggravata per utilizzo di un “mezzo di pubblicità” ai sensi dell’art. 595, comma 3, c.p. Nel caso di specie competente per materia è quindi il Tribunale e non il Giudice di Pace.
The Supreme Court states that spreading defamatory messages on Facebook integrates the offence of defamation aggravated by the use of an “medium for the availability to the public” as provided from article 595, par. 3, c.p. So the jurisdiction is of the Tribunal and not of Justice of the Peace.
