ll delitto di cui all’art. 615-bis c.p. non è configurabile, in forza dell’interpretazione sistematica del significato dell’avverbio “indebitamente”, qualora le riprese riguardino scene che, pur svoltesi in luoghi di privata dimora, siano liberamente osservabili senza ricorrere a particolari accorgimenti, posto che la tutela è limitata a ciò che si compie nei luoghi di privata dimora, in condizioni tali da renderlo tendenzialmente non visibile a terzi. Devono essere ricompresi nel concetto di “luoghi di privata dimora” tutti quelli ove si esplicano atti della vita privata, come ad esempio i locali utilizzati al cambio degli indumenti per lo svolgimento dell’attività lavorativa.
The crime provided by art. 615-bis of the penal code is not configurable, due to the systematic interpretation of the meaning of the word “unduly”, if the shootings concern scenes that, even if they took place in private homes, are freely observable without resorting to particular devices, given that the protection is limited to what is done in the places of private dwelling, in conditions that make it tend not visible to third parties. All the places where acts of private life are carried out must be included in the concept of “private dwelling places”, such as the rooms used for changing clothes for the performance of work.
