All’offesa diffamatoria consistente nell’attribuzione di un fatto determinato attraverso l’uso di una bacheca “facebook” non è applicabile l’art. 13 L. n. 47/1948 ma le aggravanti di cui all’art. 595, commi 2 e 3, c.p., dato che la bacheca “facebook” deve essere equiparata ad un “qualsiasi altro mezzo di pubblicità”, ma non può essere inclusa nella categoria “stampa”.
If the defamation consists in the attribution of a determined fact by posting on Facebook article 13 L. n. 47/1948 cannot be applied, since Facebook should be qualified as “any other form of medium for the availability to the public” but cannot be included in the category “press”
