Nel caso in cui l’hosting provider non abbia adottato tutte le misure ragionevolmente esigibili nel caso di specie per impedire la diffusione illecita di contenuti lesivi e non abbia quindi agito secondo la diligenza che può essere ragionevolmente richiesta allo stesso, deve concludersi per l’accertamento della responsabilità dell’intermediario a titolo di cooperazione colposa mediante omissione.
When the hosting provider has not taken all the reasonable measures in the concrete case in order to prevent the unlawful dissemination of harmful content and has therefore not acted according to the diligence that can reasonably be required to the provider itself, the intermediary has to be held liable for its negligent cooperation through omission.
