L’atteggiamento psicologico del reato di molestia di cui all’art. 660 c.p. deve essere caratterizzato dalla “petulanza”, che consiste nella volontà effettiva di interferire nella sfera di libertà altrui, fino al punto di determinarlo a invocare aiuto (nella specie la Corte ha ritenuto che non costituisse reato, per difetto dell’elemento psicologico, l’invio, nell’arco di 75 giorni, di 15 sms, di cui 2 a contenuto offensivo, all’ex fidanzata che non aveva attivato alcun meccanismo di blocco dei messaggi provenienti dall’ex fidanzato, il quale esprimeva essenzialmente amarezza provocata dall’interruzione del rapporto, gelosia e volontà di incontrarla di nuovo per riallacciare la relazione).
